"Since the decade of the 1990s, or the liberalisation years, there has been a shift towards pursuing a policy of market-based reforms," it had said. Jain said the nine-judge bench had ruled against imposition of a particular economic ideology, for example socialism, and argued that since the Preamble too formed part of the basic structure of the Constitution, it could not have been amended by Parliament in 1976 in violation of the 13-judge bench 'basic structure' ruling in Kesavananda Bharati case. The Big Ten took a slight dip with Ohio State’s blowout win over Indiana, but the conference is still poised to get three teams into the playoff. NCAA Division III realigned Division III football into six regions in 2021. Region 5 includes the American Rivers Conference, the College Conference of Illinois and Wisconsin (CCIW), the Midwest Conference and the Northern Athletics Collegiate Conference. Kinney, a former Central DeWitt High School standout who is now a fifth-year senior at Wartburg, was a first-team offensive tackle selection. VANCOUVER — A family of killer whales has made a rare trip into waters off downtown Vancouver for what an expert says was likely a "grocery shopping" hunt for harbour seals. Video shared on social media by False Creek Ferries shows the whales cruising past highrise towers at the entrance to False Creek on Sunday. Andrew Trites, director of the University of British Columbia's marine mammal research unit, has identified the whales as a family group of transient orcas consisting of a mother and her three offspring. Trites said the video shows the whales moving quietly like "ghosts" to avoid alerting their prey. The larger orcas appear bigger than the diminutive ferry, which measures about 20 feet long. "They're on the hunt, and so they don't want to make a big splash about it. They want to come in very stealthy-like, as though they weren't even there," said Trites. "I'm sure there were hundreds of people walking along the seawall that day and they didn't even notice and these people aboard the boat, they had a very special moment they will remember for the rest of their lives." He said it's the first time the 26-year-old mother orca, known as T35A, has shown up in downtown Vancouver with her children aged six, 11 and 14. Trites said the well documented family has previously been seen by marine researchers from Alaska to the Strait of Juan de Fuca south of Vancouver Island. He attributes the pod's surprising downtown appearance to seals also changing their habits as they hide from orcas, forcing killer whales to hunt in backwater areas like False Creek. Killer whales have previously been spotted in False Creek, including in 2019, and in 2010 a grey whale swam all the way to the end of the inlet, near Science World. Trites said researchers are hearing more reports of killer whales being seen in places where they've never been seen before. He said the behaviour captured on the video suggests the whales didn't catch anything. Trites said the sighting was an indication of the recovered health of the Salish Sea, saying it was "in a state that we haven’t seen it for over a century." He likened it to living next to Tanzania's Serengeti National Park. “It's a very healthy, vibrant system ... we've seen humpback whales come back. We've seen our seal numbers recover and stabilize," he said. Investors have been selling the financial services company's shares today after a from the Australian Taxation Office (ATO) cast doubts on the $2.175 billion sale of its Wealth Management and Corporate Trust businesses to KKR. According to the release, following ongoing and extensive engagement with the ATO, Perpetual has now received written views from the tax office. This is in relation to the tax treatment of the transaction that inform Perpetual's updated assessment of the estimated net cash proceeds to shareholders, if the scheme is implemented. The ATO has informed Perpetual that section 45B of the Income Tax Assessment Act of 1936 would apply to the scheme. This would mean that the entire cash return would be deemed to be an assessable unfranked dividend for shareholders and taxed at the applicable rate for each shareholder. In addition, the Commissioner has declined to provide Perpetual with a binding ruling that Part IVA will not apply and has also indicated that it cannot rule out that it will apply Part IVA. What's the damage? The ASX 200 stock notes that if the above were to apply, the assessed primary tax liability for Perpetual is estimated to be $488 million, without including any additional penalties and interest. This is significantly more than its previous estimate of $106 million to $227 million. As a result, the estimated cash proceeds to shareholders for the transaction would reduce from between $8.38 and $9.82 per share, as previously announced, to just $5.74 to $6.42 per share. Extremely disappointed In response to the news, the company said: Perpetual is extremely disappointed and disagrees with the Commissioner's views. Based on strong advice from relevant tax experts, including Senior Counsel, and following extensive Board testing and consideration, Perpetual continues to be of the view that the provisions should not apply. In Perpetual's assessment of the Scheme, it noted numerous previous scheme transactions that had been undertaken in a similar manner. However, it concedes that it may not be able to appeal the ruling given the impact it could have on the transaction and capital return. It adds: Perpetual considers it has strong grounds to dispute this position. However, to do so, Perpetual would need to withhold sufficient funds to cover the ATO's asserted corporate tax liability amount from any shareholder proceeds under the Scheme until completion of that process, which would be protracted, would only commence once Perpetual was assessed and there would be no certainty of the outcome. Perpetual and KKR are now engaging to consider the potential impact on the transaction. Is the transaction in danger? In recent days, Bell Potter suggested that this tax ruling could put the transaction at risk if it were not favourable. Though, it doesn't necessarily see this as a bad outcome. It said: If the ATO are pushing for more than $227m, then this should be put to shareholders, who could potentially vote against the Scheme. This might sound bad, but the equity market is now around 10% higher than it was in May, when KKR's price of $2,175m was agreed. These are good businesses and given the market, should be worth more now. Retaining them, and the Perpetual brand may be a preferable outcome to paying more than $227m in tax to the ATO.

Nearly half of American teenagers say they are online “constantly” despite concerns about the effects of social media and smartphones on their mental health, according to a new report published Thursday by the Pew Research Center. As in past years, YouTube was the single most popular platform teenagers used — 90% said they watched videos on the site, down slightly from 95% in 2022. Nearly three-quarters said they visit YouTube every day. There was a slight downward trend in several popular apps teens used. For instance, 63% of teens said they used TikTok, down from 67% and Snapchat slipped to 55% from 59%. This small decline could be due to pandemic-era restrictions easing up and kids having more time to see friends in person, but it's not enough to be truly meaningful . X saw the biggest decline among teenage users. Only 17% of teenagers said they use X, down from 23% in 2022, the year Elon Musk bought the platform. Reddit held steady at 14%. About 6% of teenagers said they use Threads, Meta's answer to X that launched in 2023. The report comes as countries around the world are grappling with how to handle the effects of social media on young people's well-being. Australia recently passed a law banning kids under 16 from social networks, though it's unclear how it will be able to enforce the age limit — and whether it will come with unintended consequences such as isolating vulnerable kids from their peers. Meta's messaging service WhatsApp was a rare exception in that it saw the number of teenage users increase, to 23% from 17% in 2022. Pew also asked kids how often they use various online platforms. Small but significant numbers said they are on them “almost constantly.” For YouTube, 15% reported constant use, for TikTok, 16% and for Snapchat, 13%. As in previous surveys, girls were more likely to use TikTok almost constantly while boys gravitated to YouTube. There was no meaningful gender difference in the use of Snapchat, Instagram and Facebook. Roughly a quarter of Black and Hispanic teens said they visit TikTok almost constantly, compared with just 8% of white teenagers.
